LITIGATION GLIMPSE – REPRESENTING THE EMPLOYEE

A client came to us, having been terminated from her previous job. Her prior attorney had filed several administrative actions (with the Labor Commissioner) against her employer. In return, the employer filed a lawsuit against our client in Superior Court, which caused her to counterclaim against the company and several of its executives. With all the paperwork flying around, our client’s prior attorney and opposing counsel (her employer’s attorney) developed a bitter relationship and the ever-escalating litigation threatened to consume all of our client’s savings. When we took over the case, numerous hearings were pending in the various forums. First, we immediately addressed the multiple forums, quickly got up to speed on the legal and factual issues, and provided our client with quality litigation representation. Then, after getting the litigation processes under control, we opened up a dialogue with opposing counsel. We showed opposing counsel our good faith by narrowing the number of proceedings without giving up any of our client’s substantive rights. We also agreed to forgo claims that had been asserted by her former attorney merely to increase our client’s bargaining position. Our strategy gained the cooperation of opposing counsel and saved our client thousands of dollars in litigation costs. Because of our efforts, opposing counsel continued to negotiate with us while the lawsuit churned its way throughout the system. Instead of marching off to a contentious trial, our client was able to settle the lawsuit, receive a cash payment from the company and some of the individuals and then set up her own business in the same field. Our transactional department formed her new company, structured the private placement stock issuance to raise capital, and continues to provide ongoing legal advice. |
